Terms of Service

1. Acceptance of Terms

By accessing or using the Flostaq platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

2. Description of Service

Flostaq is an Intelligent Submittal Review Platform designed for architecture, engineering, and construction (AEC) firms. The Service provides AI-assisted submittal analysis, compliance tracking, audit trail management, and document review workflows. All AI-generated outputs are advisory only and require professional engineer (PE) verification before any compliance determination is finalized.

3. AI-Generated Content Disclaimer

The Service uses artificial intelligence to assist with document analysis, specification extraction, and discrepancy detection. All AI-generated analysis is labeled "AI-Generated Analysis: Peer Review Required by Professional Engineer (PE)." Flostaq does not warrant the accuracy, completeness, or reliability of any AI-generated output. Users are solely responsible for verifying all AI-generated findings before relying on them for engineering or compliance decisions.

4. User Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access. Flostaq implements AES-256 encryption at rest, TLS 1.3 in transit, and PostgreSQL Row-Level Security for tenant isolation. However, no method of electronic transmission or storage is 100% secure.

5. Data Ownership & Privacy

You retain all ownership rights to your data, including blueprints, specifications, submittals, and project documents. Flostaq does not claim ownership of any user-uploaded content. We process your data solely to provide the Service and in accordance with our Privacy Policy. Your data is never sold to third parties.

6. Immutable Audit Trail

The Service maintains a cryptographically-linked audit trail using SHA-256 hash chaining. Once recorded, audit entries cannot be modified or deleted. This is a core architectural feature designed for regulatory compliance and acquisition audits. By using the Service, you acknowledge that actions taken within the platform are permanently recorded.

7. Professional Engineer (PE) Verification

Certain actions within the Service require a PE Verification Signature. By applying a digital seal, you represent and warrant that you are a licensed Professional Engineer authorized to make such determinations in your jurisdiction. Flostaq records all PE verification events with Ed25519 digital signatures for forensic traceability.

8. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to circumvent security measures including Row-Level Security policies; (c) interfere with or disrupt the integrity of the audit trail; (d) reverse engineer, decompile, or disassemble any part of the Service; (e) use the Service to process data subject to ITAR or classified defense regulations without prior written agreement.

9. Subscription & Billing

Paid features are billed on a subscription basis. All billing transactions are recorded in a SHA-256 hash-chained ledger. You may cancel your subscription at any time. Upon cancellation, your data remains accessible in read-only mode for 90 days before being securely deleted.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOSTAQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL ENGINEERING JUDGMENT.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to the address associated with your account at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
